Common questions
Does the EU Data Act apply to my business?
It applies to makers of connected products and providers of related services, to data holders, to third parties that receive a user's data, and to providers of data processing services such as cloud and SaaS, where they place products on the EU market or serve users or customers in the EU. It has applied since 12 September 2025. Micro and small enterprises are exempt from the connected-product data-access duties, but not from the cloud switching duties.
Is my small company exempt from the Data Act?
If you make connected products or provide related services and are a micro or small enterprise (under 50 people and turnover or balance sheet of EUR 10 million or less), the Chapter II data-access duties do not apply to you under Article 7, unless you have a larger partner or linked enterprise or are subcontracted to make or design the product for one. Cloud providers get no such exemption.
When do the Data Act connected-product rules start?
The Regulation applies from 12 September 2025. The duty to design connected products for direct data access in Article 3(1) applies to products placed on the market after 12 September 2026. Switching charges for cloud services end on 12 January 2027.
Does the Data Act apply to businesses outside the EU?
Yes where they place connected products on the EU market, offer related services to users in the EU, or provide data processing services to customers in the EU, wherever they are established.
Is my data uploaded anywhere?
No. Everything is calculated in your browser and nothing is sent; a test in the code asserts there are no network calls.
