What it does, and what it leaves to you
- Covers: the basic award by age band and service, the weekly pay cap, a redundancy payment set against it, a compensatory award from lost earnings and future loss, Polkey, ACAS Code and contributory-fault adjustments, the 52-week and fixed cap, and the claim deadline.
- Not decided: whether the dismissal was unfair, injury to feelings, notice pay, tax and grossing-up, benefit recoupment, Northern Ireland, and whether the caps have changed since this was written. A tribunal or an adviser decides these.
Common questions
How is unfair dismissal compensation calculated?
A basic award (weeks of pay by age and service, with the weekly pay capped) plus a compensatory award for lost earnings and rights, limited by a cap of the lower of a fixed amount and 52 weeks' gross pay. Adjustments can raise or lower it.
How long do I have to claim?
Normally three months less a day from your last day of employment. You must contact ACAS for early conciliation before that date, which pauses the clock but does not remove it.
Do I need two years of service?
For most claims today, yes. Some automatically unfair dismissals need no qualifying service, and the Employment Rights Act 2025 is expected to change the rule, so check the date that applies to you.
Is the cap always applied?
No. The compensatory cap does not apply to automatically unfair dismissals such as some whistleblowing cases. Tick the box to remove it from the estimate.
Is my data uploaded anywhere?
No. Everything is calculated in your browser and nothing is sent.
