The rules it applies, and what it leaves out
- California (Civil Code 1947.12 and 827): cap of 5% plus CPI, at most 10%, from the lowest rent in the last 12 months; 30 days notice, 90 if the increase is over 10%; five more days by mail.
- Oregon (ORS 90.323): cap of 7% plus CPI, at most 10%; 90 days; none in the first year; one in 12 months.
- Washington (RCW 59.18.140): cap of 7% plus CPI, at most 10%; 90 days.
- New York (Real Property Law 226-c, Good Cause Eviction Law): 30, 60 or 90 days for increases of 5% or more by length of tenancy; the 5% plus CPI (at most 10%) cap only for units marked good cause.
- Rules reviewed: 2026-10-06, by the author from the statutes, not by a lawyer. States publish their yearly maximum; if it differs from the formula, trust the state.
- Not decided: whether a unit is covered or exempt, local rent control and just-cause ordinances, rent-stabilized and subsidised units, lease terms, how a notice must be served, retaliation rules, and whether a notice you send is valid.
Common questions
How much notice does a landlord have to give for a rent increase?
It depends on the state and sometimes on the size of the increase. California is 30 days for an increase of 10% or less over 12 months and 90 days above that. Oregon and Washington are 90 days. New York is 30, 60 or 90 days for increases of 5% or more, depending on how long the tenant has lived there. This page applies those rules to every unit and dates the notice; check the statute for your building.
How is the California rent cap worked out?
Under AB 1482 the most a covered landlord can raise rent in 12 months is 5% plus the local change in the consumer price index, never more than 10%, measured from the lowest rent charged in the prior 12 months. Enter your area's CPI figure and the page does the arithmetic to the cent.
Do these rules apply to my building?
Not always. New construction, some single-family homes, rent-controlled and rent-stabilised units and others are exempt or governed by different rules, and many cities add their own. Mark a unit exempt in the list to skip the cap, and treat the result as a first check, not a ruling.
Does mailing the notice change the deadline?
In California, service by mail adds five calendar days. Tick the mailed box and the page adds them for California; for other states, read your service rules.
Is my rent roll uploaded anywhere?
No. It is read in your browser and nothing is sent; a test in the code asserts there are no network calls.
